I. General provisions

1.1. These Terms and Conditions for the purchase and sale of goods (hereinafter — Terms) define the procedure for ordering, payment, delivery, receipt, return and other matters related to purchases in the online store BalticDiag.lv.

1.2. The seller of the online store is BD Baltic SIA, registration number: 40203684807, VAT number: LV40203684807, legal and actual address: Piedrujas iela 30, Riga, LV-1073, Latvia (hereinafter — Seller).

1.3. The Buyer is a natural or legal person who selects, orders or purchases goods in the BalticDiag.lv online store, as well as uses other services provided by the online store.

1.4. By placing an order in the online store, the Buyer confirms that they have read these Terms, the Privacy Policy and agree to comply with them.

1.5. The Seller has the right to amend these Terms. Amendments enter into force after they are published in the BalticDiag.lv online store. Orders are subject to the Terms that were in force at the time the order was placed.

II. Registration, buyer data and privacy

2.1. In order to place an order, the Buyer must provide the information necessary for order fulfilment: name, surname or company name, phone number, email address, delivery address, invoice details and other information required for processing, payment and delivery of the order.

2.2. If the Buyer is a legal entity, it may be necessary to provide the company name, registration number, VAT number, legal address and contact person details.

2.3. The Buyer undertakes to provide complete, accurate and truthful information. The Seller is not responsible for delays or inability to fulfil an order if the Buyer has provided inaccurate or incomplete data.

2.4. The Seller processes the Buyer’s personal data for the purposes of order processing, delivery of goods, issuing invoices, accounting, warranty, returns and customer service.

2.5. Personal data is processed in accordance with applicable laws and the BalticDiag.lv Privacy Policy.

III. Ordering goods and conclusion of the purchase agreement

3.1. Goods available in the online store, their descriptions, prices and availability are indicated on the product pages. Product images are for informational purposes only, and the actual appearance, configuration or packaging of the product may differ from the image shown.

3.2. Product prices in the online store are indicated in euros with value added tax (VAT), unless stated otherwise.

3.3. Delivery costs are not included in the product price, unless stated otherwise for a specific product or during the checkout process. Delivery costs are calculated and shown before the order is confirmed.

3.4. The purchase agreement between the Buyer and the Seller is considered concluded when the Buyer has placed an order in the online store, provided the required information, selected the payment and delivery method, agreed to the Terms and confirmed the order.

3.5. After receiving the order, the Seller sends an order confirmation to the email address provided by the Buyer.

3.6. If the product is not available in stock or must be ordered from a supplier, the Seller contacts the Buyer to clarify the delivery time, price or other conditions.

3.7. The Seller has the right to refuse or cancel an order if the product is not available, if there is an obvious technical error in the price or description, if the Buyer has not made payment within the specified period or if it is not possible to contact the Buyer to clarify the order.

IV. Payment procedure

4.1. The Buyer may pay for goods using the payment methods offered by BalticDiag.lv and available at the time of checkout.

4.2. Payment may be made by bank transfer to the Seller’s bank account:

4.3. When making a bank transfer, the Buyer must indicate the order number or invoice number in the payment details so that the Seller can identify the payment.

4.4. If payment is made by another person or company, the Buyer must inform the Seller and provide the payer’s details.

4.5. If the Buyer does not make payment within the period specified by the Seller, the Seller has the right to cancel the order.

V. Delivery and receipt of goods

5.1. The Buyer may choose the available delivery or collection method during checkout.

5.2. Goods may be delivered to the address specified by the Buyer or collected from the BalticDiag Latvia store/warehouse:

5.3. When choosing delivery to an address, the Buyer undertakes to provide an accurate delivery address, phone number and other information required for delivery.

5.4. Delivery times depend on product availability, delivery method, supplier and the size or weight of the product. If delivery is delayed due to reasons beyond the Seller’s control, the Seller informs the Buyer about the possible delay.

5.5. Upon receipt of the goods, the Buyer must check the external condition of the shipment, packaging and product configuration. If damage or discrepancies are found, the Buyer must immediately inform the Seller.

5.6. If the Buyer collects the goods from the BalticDiag Latvia store/warehouse, the Seller has the right to request a personal identification document or order/invoice information.

5.7. The risk of accidental loss or damage to the goods passes to the Buyer at the moment the goods are handed over to the Buyer or to the person specified by the Buyer.

VI. Right of withdrawal and return of goods

6.1. If the Buyer is a consumer within the meaning of the Consumer Rights Protection Law, the Buyer has the right to use the right of withdrawal and withdraw from the distance contract within 14 calendar days from the day of receiving the goods, unless an exception is provided by law.

6.2. To exercise the right of withdrawal, the Buyer must inform the Seller of their decision by sending a notice to mail@balticdiag.lv.

6.3. After sending the withdrawal notice, the Buyer must return the goods to the Seller without undue delay, but no later than within 14 days from the day the Buyer informed the Seller about exercising the right of withdrawal.

6.4. The returned goods must be undamaged, complete and, if possible, in the original packaging. The Buyer is responsible for any decrease in the value of the goods if the goods have been used more than necessary to check their nature, characteristics and functioning.

6.5. The right of withdrawal may not apply in cases specified by law, including goods made to the Buyer’s individual order, activated digital licences, software, goods with damaged or opened safety packaging where return is not permitted due to hygiene, safety or other reasons specified by law.

6.6. Before activating diagnostic equipment, software licences, subscriptions or other products requiring activation, the Buyer must make sure that the product corresponds to the order and is suitable for the intended purpose of use.

6.7. The Seller refunds the money paid for the goods in accordance with applicable laws, no later than within 14 days from the day of receiving the withdrawal notice. The Seller has the right to withhold the refund until the goods have been received back or until the Buyer provides proof that the goods have been sent back.

6.8. Return shipping costs are covered by the Buyer, unless the Seller has stated otherwise or applicable laws provide a different procedure.

6.9. If the Buyer is a legal entity or the goods were purchased for business purposes, the right of withdrawal does not apply, unless the Seller and the Buyer have agreed otherwise.

VII. Product quality and warranty

7.1. The Seller ensures that the goods correspond to their description, configuration and applicable legal requirements.

7.2. Goods are subject to the warranty provided by the manufacturer or supplier, if such warranty is provided for the specific product. Warranty terms and conditions may differ depending on the type of product and the manufacturer.

7.3. The warranty applies to manufacturing defects and non-conformities caused by the manufacturer or product quality.

7.4. The warranty does not apply to damage caused by incorrect installation, improper use, mechanical damage, chemical exposure, moisture, improper storage, unqualified servicing, failure to follow the user manual or other reasons resulting from the Buyer’s actions.

7.5. In case of a warranty claim, the Buyer must contact the Seller and provide a document confirming the purchase, a description of the defect and, if possible, photo or video materials.

7.6. The Seller has the right to send the product for inspection to the manufacturer, supplier or authorised service centre in order to determine the cause of the defect.

7.7. If a manufacturing defect is confirmed, the Seller provides product repair, replacement, price reduction or refund in accordance with applicable laws.

VIII. Buyer’s rights and obligations

8.1. The Buyer has the right to purchase goods in the BalticDiag.lv online store in accordance with these Terms.

8.2. The Buyer has the right to receive information about the product, its price, delivery, warranty and conditions of use.

8.3. The Buyer undertakes to pay for the ordered goods, provide accurate information and receive the goods according to the selected delivery or collection method.

8.4. The Buyer undertakes to use the purchased goods in accordance with the manufacturer’s instructions, safety requirements and intended purpose of use.

IX. Seller’s rights and obligations

9.1. The Seller undertakes to process the Buyer’s order, ensure delivery or collection of the goods, issue an invoice and provide information about order fulfilment.

9.2. The Seller undertakes to respect the Buyer’s privacy and process personal data in accordance with the Privacy Policy and applicable laws.

9.3. The Seller has the right to contact the Buyer to clarify order information, delivery conditions, product availability or payment matters.

9.4. The Seller has the right to refuse order fulfilment if the Buyer has not made payment, has provided inaccurate data, the product is not available or order fulfilment is impossible due to other objective reasons.

X. Liability

10.1. The parties are responsible for non-performance or improper performance of these Terms in accordance with the laws of the Republic of Latvia.

10.2. The Seller is not responsible for losses caused by incorrectly provided Buyer data, improper use of the product, actions of third parties, delays by delivery service providers or force majeure circumstances.

10.3. The Seller is not responsible for temporary unavailability of the online store due to technical maintenance, system disruptions or circumstances beyond the Seller’s control.

XII. Dispute resolution and final provisions

12.1. These Terms are prepared and applied in accordance with the laws of the Republic of Latvia.

12.2. All disagreements between the Buyer and the Seller are first resolved through negotiations, with the Buyer contacting the Seller by email at mail@balticdiag.lv.

12.3. If the Buyer is a consumer and the dispute cannot be resolved through negotiations, the Buyer has the right to contact the Consumer Rights Protection Centre or the Consumer Dispute Resolution Commission in accordance with the procedure established by law.

12.4. Disputes that cannot be resolved through negotiations or out-of-court procedures are resolved in the courts of the Republic of Latvia in accordance with applicable laws.

12.5. If any provision of these Terms becomes invalid or is declared invalid, this does not affect the validity of the remaining provisions.
